Shipping Structure SUMMARY:
All standard orders shipped via UPS incur shipping charges based on 10% of your product total for all orders.
All standard orders shippied via Canada Post incur shipping charges based on 20% of your product total for all orders.
All orders shipped via DHL incur shipping charges based on 30% of your product total for all orders.
We use a graduated flat rate for small orders for shipping to three freight regions:
Region 1 - Contintental US,
Region 2 - Alaska, Hawaii, & other US properties, and
Region 3 - Canada.
We add a maximum of $9.00 (Region 1 & 3, except if delivered by DHL) and a maximum of $15 (Region 2, delivery by Priotiy mail only) to all order under $75, depending on your region.
If your order is between $75 and $96, the small order charge is reduced to $6.50 for Regions 1 & 3, with UPS and Canada Post deliveries only.
If your order between $75 and $96, the small order charge is reduced to $12.50 for Region 2, priority mail delivery.
DHL delivery to Canada is 30%, plus $20 (if order is under $75)
Rush orders are accepted but you will pay significantly more -- usually about 30% more. See Rush Order information in the

We carry a few items that are large or heavy which require additional shipping charges. These items are notated in their descriptions throughout the website. However, most of our items do not require this extra charge.
We also are required to collect taxes for all orders shipped to Arizona, California, and Ohio. The Tax Schedule is provided in the Shipping Structure Details section.

Why Do I Have to Pay Tax?
Ohio consumers are required by the Ohio Tax law to pay sales tax on all purchases. The current Ohio State Sales Tax is 6%, but counties and Regional Transit Authorities (RTA) may assess an additional .25% to 1.5% tax each, not to exceed 9% total Ohio Sales Tax.
If the amount of tax paid in less than the tax the consumer would paid in the county where it is delivered, then that consumer is responsible for a “In-State” Use Tax. (A Use Tax is the difference between a lower sales tax paid and the amount that would be assessed by a tax rate in your county where you received and used the purchase.) However, if the consumer defaults on paying the Use Tax, the vendor is responsible to pay the tax.
Therefore LyonSmith, Inc has set the following policies regarding Ohio Sales Tax and Ohio Use Tax:
LyonSmith, Inc is located in Springfield, Clark County, Ohio. The current Sales Tax rate for Clark County Ohio is currently 7%. However, your county’s Sales Tax rate may be higher or lower. We will collect the rate in effect for your county at the time of your order. This policy should effectively exempt and protect the consumer from any additional assessment of Ohio Sales Tax or Ohio Use Tax. You may print or copy this policy in the event you are audited for the back taxes.
Our supplier, Windy Acres Gifts, provides product from a warehouse in California. Therefore, if you use a California delivery address, you will be charged a flat rate Sales Tax, currently 8.25%. You will be responsible for any adjustments to the Use Tax laws. Neither Windy Acres Gifts, nor LyonSmith, Inc, will be responsible for any defaults under California Tax laws.
LyonSmith, Inc is charged a flow-through tax for all Arizona deliveries. Therefore, if you use an Arizona delivery address, you will be charged a flat rate Sales Tax, currently 5.6%. You will be responsible for any adjustments under your regional and state Use Tax laws. LyonSmith, Inc will not be responsible for any defaults under Arizona tax laws.
All other customers in states that have Sales Tax and Use Tax laws will be responsible to their respective states for any taxes assessed. LyonSmith, Inc will reject any future claims for back taxes made due to the default of responsibility of their customers.
Because of the good-faith efforts LyonSmith, Inc takes in order to comply with the increasing demands of government entity taxations, LyonSmith, Inc and its supplier, Windy Acres Gifts, will reject any and all other claims for any and all delinquent taxes based on its consumer’s failure to filed or pay any and all applicable taxes.
If you disagree with current Federal and State tax policies, please direct your appeal to your authorized government officials to reduce your burden. The numbers and addresses for tax policy makers should be in your phonebook.
About Your Order
How long before I receive my order?
WINDY ACRES GIFTS processes and ships orders within 1 to 2 business days of receipt. All orders are shipped via UPS (estimated time for delivery is 7-10 days, pending verification of payment), unless an alternate shipping method is specified. If an alternate method is chosen, delivery time will depend upon the type of shipping service you've specified and your location.
How much will my shipping costs be?
Your freight costs reflect a percentage of your order size.
What type of package will I receive?
The packing slip on your drop-shipped order will show the WINDY ACRES GIFTS name and address, the item numbers, and the quantities ordered. No prices are shown, therefore it is important that you print or save a copy of your online receipt.
How can I have an order rush-shipped?
Rates are higher for DHL Rush Service, USPS Post Office boxes, and all shipments outside the continental U.S. Therefore, we encourage you to avoid using rush service and have goods shipped to a physical address rather than a P.O. Box, whenever possible, to minimize freight costs. However, we will send your order by rush delivery, upon request. Simply choose a faster shipping method than the default UPS shipping when you place your order.

All the sizes of products indicated or shown on our websites are close approximations. AUTHORIZATION FOR RETURN OR REPLACEMENT
To obtain an authorization to return a defective item for credit or replacement, simply contact LyonSmith, Inc within 30 days of purchase.
Non-defective merchandise returns will incur a 20% restocking fee, and must also be returned within 30 days of purchase.
CONDITIONS
Non-defective merchandise must meet the following conditions to qualify for return acceptance:
a. Merchandise must be in its original minimum inner pack quantity, as shipped by our supplier, WINDY ACRES GIFTS. Broken quantity inner packs are not returnable.
b. Merchandise, merchandise packaging, and inner pack must bear no markings or be otherwise defaced or damaged.
ITEMS WITH GUARANTEES OR WARRANTIES
If a purchased item includes a product guarantee or warranty, follow the instructions on the guarantee or warranty for repair or replacement.
ITEMS DAMAGED DURING SHIPMENT
All merchandise damaged during shipment is covered by the shipper. If you receive merchandise damaged during shipping, please contact LyonSmith, Inc within 14 days of the date of shipment of your order, and your claim will be processed immediately.
NOTE: Established procedures by UPS, U.S.Parcel Post, and trucking lines, must be complied with or they may deny your claim.

Q: I received a package. Upon examination I found a broken ceramic vase. Should I place a claim with the carrier or return it?

Q: What procedure do I follow if I place a claim for a lost shipment and it arrives soon after?
A: Please notify LyonSmith, Inc. immediately so we can close our files without continuing unneccessary expenses.
Q: My order has been lost. I need it now. Can't you just send a duplicate?
A: UPS, Parcel Post, and trucking firms will not accept any responsibility for hardships caused by lost shipments. We regret that we cannot assist you in this manner. We suggest you place and pay for a duplicate order. When the carrier validates your claim, we will credit your account or send a refund check at your request.
Q: I received a timepiece that doesn't work. I bought it 3 weeks ago and didn't realize it didn't work properly. What's the procedure on this?
A: Any timepiece received in a defective condition that doesn't show signs of wear, which is returned to us within 30 days of purchase date in its original display box, can be returned for credit or replacement. A Return Authorization Form must be used as no merchandise can be returned without prior consent.
Q: I have worn the defective watch and it does show signs of wear. Won't you repair it?
A: Yes. Any defective watch purchased from us that shows signs of wear will be repaired free of charge, providing it was purchased within the previous 30 days. Proof of date and purchase (your invoice) must be included, as well as a note saying the watch is defective, with a brief explanation if necessary. Send to:

Q: If a 14K gold item is $39.95 or less, is it covered by the costume jewelry guarantee?
A: No. All 14K gold jewelry is covered by the 14K gold warranty regardless of cost.
Q: Your costume jewelry guarantee is really great! This guarantee offers replacement regardless of reason for only a small service fee. Do you have a similar guarantee for the 14K gold jewelry?
A: We offer a separate warranty for 14K and 10K gold jewelry. Gold and gems are by far the biggest cost factor in 14K/10K gold jewelry compared to labor for costume jewelry. The only feasible guarantee we can offer for 14K/10K gold jewelry is to guarantee that it's exactly as described. Money will be refunded if the 14K/10K gold jewelry is returned in perfect resalable condition, exactly as received and unused, within 10 days of receipt. There is no restocking fee when 14K/10k gold jewelry is returned under the conditions of the guarantee.

WHAT IF I HAVE A CLAIM?
Every effort is made to see that your orders are shipped correctly and that they reach you safely. Every order is double-checked for accuracy.
We seek the best value which takes into account price as well as quality. We believe we offer the best quality for the lowest possible price. However, quality is subjective and viewed differently by each person. What appears to be a flaw to one person may be viewed as a natural mark of beauty to another.
We uses styrofoam pellets as cushioning material when packing your order. These pellets are much more costly than shredded newsprint which is commonly used. The pellets do not compact, and therefore offer more protection. They are much lighter than shredded paper thereby saving you shipping costs.
Despite all of these precautions, claims do arise.
Our adjustment and return policy is truly very simple. We want to protect you and make you feel comfortable — and make certain you get what you pay for. We have established some requirements to make our policies and programs workable.
CLAIMS
Claims will fall under the following categories: (1) Lost order, (2) Damaged merchandise, (3) Shortage on order, (4) Defective merchandise, (5) Wrong item sent, (6) Manufacturer's Guarantee defect.
LOST ORDERS
It doesn't happen often, but carriers such as UPS, truck lines and Parcel Post do lose orders. If you have placed an order and have not received it in a reasonable period, do the following:
1. Contact us. Please have the following information ready:
a. Your name as it appears on your order.
b. Your online order confirmation number reflects the order in question.
c. The date your order was submitted.
d. Approximate dollar amount remitted and how the order was paid. Personal check? Charge card? Money order?
e. If a partial order was delivered and the invoice is included in one of the delivered cartons, please have this invoice available and a list of the missing items. Advise our Adjustment Department of the number of cartons received.
2. We will check our computer to find the date your order was shipped and the carrier used.
3. We will initiate a tracer with the carrier. Normally a response is received within 10 working days after the tracer is initiated. Most carriers require a 10-day waiting period before they will accept a tracer request. The U.S. Postal Service requires a 30-day waiting period from date of shipment before they will accept a tracer. (90 days outside continental U.S.)
4. We will notify you when we receive the result of the tracer. Results of a tracer are generally one of the following:
a. The Carrier is unable to prove delivery. Therefore, credit has been issued to your account, or we have reshipped your merchandise as you requested.
b. The Carrier will submit a photocopy of a delivery receipt which will show the order was delivered in full, the date it was delivered, and the signature of the person who received the order, if applicable.
c. If a signature is not yours, a neighbor's or a member of your family's, our Adjustments Department will initiate a denial of signature claim with the carrier. This will require an additional 7 to 10 working days. We'll notify you of the results and may request additional information.
d. The Carrier may have returned the order to us for the following reasons:
i. UPS made three attempts at delivery to you and no one was home.
ii. Your delivery address is a Post Office Box. UPS does not deliver to a Post Office Box. They notify you, but if no response is made within seven days, the package is returned to the warehouse.
iii. You have moved and your order was sent to your former address. The package may have been retained by someone who signed for the package at your old address, or the shipment was returned to the warehouse.
DAMAGED MERCHANDISE
Inspect each box for signs of damage such as crushed, torn, open, unseamed tape, etc. If you do find outward damage, sign the receipt with the words "Exception – Damage." For United Parcel Service deliveries, contact us and give the invoice number or the shipment involved. Explain the damage involved, number of cartons received and whether you desire a replacement or credit to your account. This information will prepare us for a claim report from the carrier.
Hidden Damage by carrier:
If you should receive a shipment delivered by carrier that shows no visible damage, but upon inspection you discover damage due to evident rough handling, contact us within 14 days of invoice date and report the damage. We will issue credit or replacement at your request.
Shortages If you receive an order from LyonSmith, Inc. via WINDY ACRES GIFTS and find it has not been filled completely:
1. Check your invoice. If the item is out of stock, it is not charged on your order. Thoroughly check the cartons and packing. Small items may be under the packing material. Upon receipt, check the condition of the cartons. If there is a shortage due to tampering, a claim must be placed with the carrier. Follow the same procedure as if there is damage.
2. If there is no tampering and an actual shortage exists, contact LyonSmith, Inc. We'll need to know the invoice number, number of cartons received, the missing item number, and whether you prefer credit or a replacement.
3. We will investigate the shortage. When the item is confirmed as not shipped, it will be shipped or credit will be issued to your account, whichever you prefer.
If our checking procedures indicates all items were shipped, we will advise you.
